Rostermind Terms of Use
Version dated October 25, 2026.
1 Parties and purpose
Rostermind is operated by Custom County inc., referred to as “Rostermind” in these terms. The organization subscribing to the service is referred to as the “Customer”. A person acting for that organization must be authorized to bind it. Employees and other individuals to whom the Customer grants access are its “authorized users”.
The service includes the Rostermind features actually made available under the plan, options, permissions and accepted order. It is intended for professional and organizational use. Visiting the website or accessing a public example does not constitute the purchase of a subscription. Its professional purpose does not remove any mandatory right that applies.
2 Acceptance and applicable documents
These terms take effect for the Customer when expressly accepted during subscription or in a written agreement that refers to them. The version provided to the Customer must be available before acceptance and capable of being retained by the Customer. Creating access for an employee does not make that employee personally liable for the organization’s subscription.
An order, quotation or specific agreement accepted by the parties sets out the services, quantities, prices and particular commitments. An express variation in that agreement takes precedence over the corresponding general provision. The other provisions continue to apply, subject to mandatory law.
The privacy policy explains practices concerning personal information and remains a separate document. A data processing agreement may supplement the relevant commitments. Documents incorporated into a contractual obligation must be identified and available before acceptance. A later change to a website page does not, by itself, rewrite an existing contract.
3 Accounts and authorized users
The Customer provides accurate information, designates its administrators and assigns rights appropriate to its users’ duties. It protects its means of access, removes access that is no longer needed and promptly reports any unauthorized use it becomes aware of to support@rostermind.com.
Individual accounts are used by the people to whom they are assigned. The Customer remains responsible for the instructions it gives and access it authorizes. Rostermind retains its own security and information protection obligations; a Customer error does not automatically release Rostermind from its obligations.
4 Trial and paid subscription
The standard trial is temporary and lasts 14 days. It provides access to the product features then available within the communicated trial scope, subject to the stated usage limits and allowances. A feature temporarily available during a trial is not necessarily included in every paid plan.
The trial does not automatically trigger a purchase or paid subscription. To continue with a paid offer, the Customer must confirm the corresponding commercial terms. When the trial expires, access may be limited under the stated conditions. These terms do not provide a permanent free plan.
5 Prices and billing
The applicable price is the price accepted for the plan, options, quantities and services ordered. Unless an expressly accepted offer states otherwise, website prices are in Canadian dollars before tax. Viewing the website from the United States does not convert those amounts into US dollars.
Standard billing is monthly. Applicable taxes and billable items are specified during the commercial process and on the invoice. An annual subscription, discount, personalized assistance or network agreement requires separate agreement; none is granted automatically.
The Customer uses a payment method it is authorized to use. Payments are processed by the payment provider identified during purchase. A paid feature may depend on payment confirmation and account permissions. The Customer may report a billing error to support@rostermind.com; statutory rights to dispute remain applicable.
6 Workers and changes in scope
Under the current standard pricing schedule, the plan base includes ten active, schedulable workers per day. The accepted charge for each additional worker is prorated for the relevant days. The same person is not counted twice for the same day under the same payer. The mere existence of an administrator account does not constitute a billable worker day.
Calculation rules and the applicable cost are presented before a paid change is confirmed. Adjustments may be combined on a later invoice or require an interim payment disclosed before the new access is enabled. A credit applied to an invoice does not necessarily constitute a refund to the payment method.
An à-la-carte option may have a minimum commitment of 30 calendar days when stated in the accepted offer and permitted by applicable law. A feature already included in a plan is not charged a second time as an option. A change in prices or rights respects the existing agreement and does not apply retroactively merely because the website is updated.
7 Renewal and cancellation
A monthly subscription renews from month to month until cancelled under the accepted terms. An authorized administrator may request that the next renewal be stopped through the billing portal provided in the account or, if unavailable, by writing to support@rostermind.com from an address authorized for the organization.
When cancellation at the end of the period is requested before the relevant renewal is triggered, the service normally remains accessible until the end of the period already paid for. The confirmation states the applicable end date. The receipt date of a valid request may be established from account or email records; a request does not become late solely because of Rostermind’s processing time.
This arrangement does not restrict a right to immediate termination or refund under the law or a particular agreement. A request to delete an account and a subscription cancellation serve different purposes. The Customer specifies its intention to avoid deletion of data it still wishes to retain.
8 Refunds and correction of errors
A cancellation for convenience at the end of a paid period does not automatically trigger a refund for that period when the agreed access is maintained. This rule remains subject to mandatory rights, the accepted agreement and circumstances warranting another solution.
An amount charged in error or twice is corrected after verification. When a refund is due, its processing is explained to the Customer. A request concerning a paid service that was not provided is assessed according to the facts, applicable commitments and law. These terms do not establish a blanket exclusion of all refunds.
9 Non-payment and suspension
If a payment fails, Rostermind informs the Customer and allows it to resolve the situation within a reasonable period communicated to it. Non-payment does not create a free plan or authorize activation of new paid features without confirmed payment. Amounts actually due for services ordered remain payable, subject to substantiated disputes.
Rostermind may limit or suspend access because of unresolved non-payment, unlawful use or a serious security risk. The measure must be proportionate to its reason. Where circumstances permit, the Customer receives advance information and an opportunity to correct the situation. A security emergency may justify immediate action, followed by information as soon as reasonably possible.
Suspension does not amount to immediate deletion of all data. Retention, return of data and closure are handled separately. Rostermind neither retains nor deletes information in violation of an applicable legal obligation or valid instruction.
10 Permitted and prohibited uses
The Customer and its authorized users use the service for their lawful professional activities within the scope of the subscribed offer. They must not seek to access another organization’s data, bypass permissions, compromise security, introduce malware or abusively disrupt the service.
The Customer has the necessary permissions for the files and information it submits. It does not use the service to send unlawful communications, infringe a third party’s rights or obtain a paid feature by circumvention. Usage limits applicable to a feature are communicated in its commercial context or its own documentation.
11 Decisions and assisted features
Rostermind helps organize schedules, availability, assignments and operations according to the features actually accessible to the Customer. The Customer checks settings, information quality and the suitability of results for its activities. It retains control over decisions made using the service.
Calculations, suggestions and examples do not guarantee coverage, revenue, savings, regulatory compliance or accuracy in every context. Employer obligations, compensation decisions and professional or sector-specific requirements remain to be checked by competent individuals. This does not reduce Rostermind’s own commitments or the Customer’s mandatory rights.
When an artificial-intelligence-assisted feature is offered, its access conditions, limits and any usage charges are specified before activation. Subscribing to a plan does not automatically include every artificial intelligence feature. The relevant results must be checked according to their use, and submitted information must respect applicable permissions.
12 Data and confidentiality
The Customer retains its rights in its data. It authorizes the operations necessary to provide, support and secure the service, according to applicable instructions and documents. This access does not transfer ownership of Customer data to Rostermind or remove individuals’ rights concerning their personal information.
The respective roles of the organization and Rostermind depend on the actual processing. Instructions, suppliers, safeguards and processing arrangements requiring a particular agreement are specified in that agreement. A use requiring specific sector commitments must be defined before the relevant processing takes place.
The privacy policy describes practices and contact points for personal information. A standard plan does not, by itself, guarantee that all data resides within a particular province, country or region. A customized regional hosting commitment must be defined and accepted in writing for a precise scope.
13 Return of data and closure
Before closure, an authorized administrator may ask support@rostermind.com about arrangements for recovering the organization’s data. Available return options, formats, identity checks and any particular work are explained before being carried out. A paid customized service requires an accepted quotation; it does not replace the exercise of a statutory right of access or disclosure.
Closing an account does not imply permanent technical access to the service. Cancelling a subscription does not automatically create an additional period of access or recovery. Data that may be returned or retained depends on the account scope, valid instructions, legal obligations and applicable safeguards. Retention periods and the end-of-service procedure must be communicated in the documents governing that processing.
An individual deletion request does not amount to an employer’s instruction to destroy all its operational records. Rostermind may need to coordinate a request with the organization controlling the information. Account or data deletion requests use the pages and contact listed in section 18; the statutory rights of the individuals concerned remain reserved.
14 Availability and support
Rostermind uses reasonable means to provide and maintain the agreed service. Maintenance, incidents or external dependencies may cause interruptions. These terms do not create a commitment to absolute availability or a guaranteed restoration time.
Support is available at support@rostermind.com. Its scope and any assistance services are those of the accepted offer. A service level, dedicated assistance or customized intervention requires a separate written commitment. The Customer reports issues with useful details while avoiding unnecessary secrets or personal information.
15 Third-party services and intellectual property
Some features may require an account or authorization with a third-party provider, for example for payments or an accounting connection. The Customer remains responsible for its own third-party subscriptions and the permissions it grants. Provider fees are included only when stated in the accepted offer. An integration announced for the future is not a service already provided.
The relevant provider’s terms govern its own service. An external dependency does not remove Rostermind’s obligations to the Customer, particularly when a provider acts on its behalf. The scope of a connection and the effects of revoking it are explained in the context of the feature.
Rostermind and its licensors retain rights in the software, trademarks and content they provide. During the agreed access period, the Customer has a right to use them for its authorized needs. It may not resell the service or reproduce its protected elements beyond what the agreement or law allows. Product feedback does not transfer the Customer’s rights in its data.
16 Liability and reserved rights
Each party is responsible for the consequences of its own failures under the agreement and applicable law. The Customer takes reasonable steps to limit the worsening of harm it becomes aware of. Essential obligations, express commitments and remedies protected by law remain applicable.
Intentional or grossly wrongful conduct does not benefit from a contractual exemption for material damage. Bodily or moral injury remains subject to applicable mandatory protections. No provision is to be interpreted as removing a right that the person concerned cannot validly waive.
17 Changes to the service and terms
Rostermind may develop the service and propose new terms. A material change affecting the accepted offer, price or Customer rights must be communicated before application, respecting the existing agreement and applicable legal rules. A website announcement alone does not retroactively change periods already paid for.
The new version and its effective date must be identified. Where Customer acceptance is required, it must be obtained through an appropriate mechanism. The Customer retains rights of refusal, termination or remedy provided by law and the agreement. A change cannot arbitrarily remove a particular commitment accepted in writing.
18 Languages, applicable law and contact
For situations subject to Quebec language requirements, the French version is made available during the contractual process before another language choice is retained, in accordance with applicable rules. An English or Spanish version must not reduce Customer rights. A language preference does not, by itself, constitute waiver of a legal protection.
To the extent this choice is permitted, the agreement is governed by the laws of Quebec and the federal laws of Canada applicable there. Mandatory rules and required court jurisdiction in the relevant place remain reserved. These terms do not impose mandatory arbitration or a general waiver of remedies. Particular commitments needed for an outside market must be examined before adoption.
Questions, complaints or requests concerning the service may be sent to support@rostermind.com. The Customer identifies its organization and relevant facts. The parties first seek a good-faith solution without preventing remedies or steps a person may lawfully take.
